# Terms and Conditions (Short Version)

     The summed up, short version first (for those that just want to get to the point):

   This site (https://www.ghostagent.net) is a poetry site.  The poetry can get dark and involves themes of trauma and abuse and due to this, much thought and care has been given in creating the site to help honor and respect its viewers. Please be aware that this site is intended for an adult (18+) audience.

   With that said, this site collects as little as possible to keep the site running, but GhostAgent™, LLC uses 3rd party tools for offering certain services and if you choose to participate in using those services and volunteer information to ensure those services work (such as giving your email address to sign up for a newsletter). Just use common sense regarding what information is necessary for those services to function if you choose to use them. 

   Using the prior example: signing up for a newsletter requires an email address, if GhostAgent™, LLC offers merchandise, then ordering something will require your name, and shipping information.  If you use those services, that information will be shared with GhostAgent™, LLC so that those services can function.  The special note is payment processing—GhostAgent™, LLC does not see or access your payment information—that is handled exclusively by FourthWall.

   Browsing the site is fine and respects visitors privacy.  Further, the poems and stories on this site are written by GhostAgent™, LLC and if you copy it and claim it, it isn’t yours. Again, just typical common-sense stuff. (Standard copyright protections apply.) Further, to enhance your experience here GhostAgent™, LLC uses licensed music and possibly other music granted permission by the artist.  All permissions and licensed music (or other form of art) are listed in our Acknowledgements page.

   Browse responsibly and apply common sense—like with every other site.  That’s the short and sweet of it.

     These Terms and Conditions (“Terms”) govern your access to and use of GhostAgent™, LLC ("we," "us”, “our" or "the site") at GhostAgent.net. This site is a personal creative project focused on poetry and written expression. It includes content covering mature and potentially distressing themes.    All poetry, prose, and artistic content on this Site is fictional and creative in nature. While inspired by real emotions and experiences, all works are artistic expressions and should not be interpreted as factual accounts, defamatory statements, or representations of real persons or events.

   Characters, names, businesses, places, events, locales, incidents, and circumstances within the works may be fictionalized, composite, altered, or otherwise transformed for artistic and literary purposes.    All original poetry, prose, and written content created by GhostAgent™, LLC is protected by applicable copyright law from the time it is fixed in a tangible medium. Certain works may be registered with the United States Copyright Office, which can provide additional procedural and remedial advantages under applicable law.

### 3.2 AI-Generated and AI-Enhanced Imagery

   Visual artwork displayed on this Site may include images generated or enhanced using artificial intelligence. While Lumo (by Proton AG) is our primary tool, we may also use other AI services to modify, expand, upscale, or enhance visual assets.

Regarding AI-generated or AI-enhanced content:

   Images created solely by artificial intelligence may not be subject to exclusive copyright ownership under certain jurisdictions, including United States Copyright Office guidance.

   Copyright protection for such material depends upon applicable law and the extent of human creative authorship.

   GhostAgent™, LLC claims copyright only in those portions for which it has a legally supportable copyright interest, including qualifying human-authored modifications, selection, coordination, arrangement, or other original contributions.

   User agreements with respective AI service providers (e.g., Proton/Lumo) govern contractual ownership rights between users and the service providers.

   Audio content on this Site is licensed through Pond5.com under a subscription license. All music remains the property of its respective composers and licensors. Users are granted a limited, non-transferable right to stream audio content through the Site. Downloading, ripping, or redistributing music is strictly prohibited.

## 5. Donations, Memberships, and Merchandise

### 5.1 Transaction Processing & Data Flow

   Donations, memberships, and merchandise purchases are processed through FourthWall. FourthWall serves as the Merchant of Record for all transactions. As the Merchant of Record, FourthWall handles payment processing, tax collection, returns, and customer service inquiries.

   GhostAgent™, LLC receives order-related information necessary to fulfill requests. Payment card information is handled exclusively by FourthWall and is not directly accessed by GhostAgent™, LLC.    Transaction-related information is used only to fulfill requests, manage memberships, improve service, and maintain records.    GhostAgent™, LLC may offer membership subscriptions through our integrated FourthWall platform. Memberships may provide access to exclusive content, community features, or other benefits. All membership transactions, billing, and cancellation processes are handled by FourthWall under their terms.
